Heritage Hall Building Rental Agreement

  1. The Rental Agreement is by and between City of Coldwater (Dr. Browne Recreation Center) and the Renter.
  2. What the Heritage Hall is to be used for. The City rents to the Renter.
  3. The renter may use the Building on this date from this time. Keys may be obtained 24 hours prior to use.
  4. Ending Time
  5. The Renter, in consideration of the rental, has paid the rental fee.
  6. Security Deposit
    The Renter will deposit 50% with the City as a security for the faithful performance of all conditions and contents in this agreement. The City may use the security deposit to pay for any damages caused by the Renter, including failure to return Heritage Hall's key. If damages caused by the Renter exceed the amount of deposit the Renter agrees to pay those amounts forthwith upon receipt of notice of damage and the amount. If the Renter complies with all the terms of the agreement, the security deposit shall be returned to the Renter after the City has inspected Heritage Hall.
  7. Use
    The Renter may not use or knowingly permit any part of Heritage Hall to be used for any unlawful purpose, and the Renter shall comply with all applicable Federal, State, and local laws, orders and regulations; and with all lawful directives of public officers and upon it with required permits and licenses with respect to its use of Heritage Hall. The Renter acknowledges that no alcoholic beverages may be consumed in Heritage Hall or the surrounding park.
  8. Assignment
    The Rental shall not assign this agreement in whole or in part.
  9. Access to Building
    The City or its agents may enter Heritage Hall at any time during the rental term for purposes of inspection or repair. The City shall not be liable for inconvenience, annoyance, disturbance, or other damage to the Renter because of such entry and the City reserves the right to conduct activities which may occur during the time when the rental is scheduled.
  10. Return of the Possession
    At the expiration of the rental term, the Renter shall return Heritage Hall to the City in as good condition and repair as it was at the beginning of the term. Keys shall be returned to the City as soon as possible after the expiration of the rental term.
  11. Default
    Any Renter found in default of any of the conditions of the agreement shall be immediately evicted.
  12. Liability / Indemnity
    The Renter shall be liable for any injury to or death of a person and for any loss and/or damage to Heritage Hall caused by the negligent acts or omissions of itself, its agents, employees or invitees, or caused by the Renter's failure to perform the conditions of this agreement. The Renter shall indemnify and hold the City by reason of any of the causes for which the Renter is liable pursuant to this paragraph.
  13. Entire Agreement
    This agreement constitutes the entire agreement between the parties. The Renter is not relying on any representatives or agreements other than those contained in this agreement.
